Both the navigation through the website www.nitacare.com and its subdomains, as well as the purchase of any product at the addresses provided, presupposes the acceptance of the general conditions of use on this page. By using this site you are automatically agreeing to its rules.

NC Pharma Unipessoal Lda, NIPC 515307319, based in Rua Conselheiro Veloso da Cruz, No. 621, 4400-095 Vila Nova de Gaia, hereinafter called NITACARE, reserves the right to freely modify the present information in order to adapt it to the applicable legislation without prior notice, by ressaving the contracts already concluded and running, so we recommend visiting this page to be aware of any changes.

These conditions establish pre-contractual information in contracts concluded at a distance on the website www.nitacare.com and all subdomains, referred to in article 4 of Decree-Law No. 24/2014 of February 14.

User is deemed to be any person with a minimum age of 18 years who creates a customer account, under the commitment that all information relating to his/her identity and other necessary data for placing and processing the order is true.

The user undertakes to use this website in compliance with the applicable law, refraining from using the Web page for activities contrary to the law, morals and good customs, or rights and interests of third parties..

The website www.nitacare.com may have links to other websites, which may contain useful information for its users. These general conditions shall not apply to third party websites, including content control, availability, operability or performance. As such, if you visit another website, redirected from ours, you should read its privacy policy.

NITACARE is not liable for any facts arising from the unavailability of the site, whatever its duration.

2. Intellectual Property

All content and information contained in www.nitacare.com and its subdomains are the property of NITACARE or its suppliers, and therefore the use, reproduction, copying and disclosure by any means is subject to its prior consent.

All trademarks or related services are the property of NITACARE or its owners who grant NITACARE the right and licence to use their trademark.

3. Product and Price Information

  • Product Information

NITACARE makes every effort to ensure that all details, descriptions and content presented on the site are updated, revised and correct. However, we cannot guarantee the absence of incorrect information or typographical errors. In these cases, NITACARE reserves the right not to follow up on orders with these products. If you order these products, customer service will contact you to inform of the impossibility of proceeding with the process. NITACARE is not liable for errors or omissions in the contents of the site.

Sometimes orders may not be shipped for other reasons, such as out-of-stock product, inability to obtain payment authorization or order deemed fraudulent.

All products in promotional campaigns are limited to the available physical stock and/or the units stipulated for the campaign.

When it comes to promotional campaigns of the respective supplier, the user agrees that NITACARE will cut or remove the barcodes or other identifying elements necessary to participate in the promotional campaign. This circumstance does not prejudice the rights conferred by law to the client.

The information provided on this site is not intended to replace the opinion of a healthcare professional or specialist, and the information presented is only informative.   • Price Information

The retail prices shown at www.nitacare.com and their sub-domains are presented in Euro currency, with the Portuguese VAT rate already applied in all mentioned products. NITACARE may change prices without notice.

Even when prices are presented in other currencies, payments are always made in euros, and some banks may charge exchange rates. This situation is totally unrelated to NITACARE who is not responsible for it.

The shipping costs are borne by the user and added to the total value of the selected products. Before confirming your order and completing the purchase process, the user will be informed of these charges.

In the event of a computer error, manual or any other origin, which causes a substantial change not foreseen in the selling price to the public, so that it becomes a large or insignificant amount, the purchase order shall be deemed invalid and annulled.

4. Purchase process

To place an order, the User must register on the website www.nitacare.com, filling out an electronic form with the necessary data to be able to deliver the order (name, email, phone and delivery address). Required fields on available forms are marked with an asterisk (*). After registration, the User may purchase the product(s).

Upon completion of the ordering process the User has a deadline, indicated on the payment method selected, to proceed to the payment. After this time, if there is no payment confirmation and no billing option has been selected, the order will be voided.

  • Payment options

To place an order outside the Portuguese territory you can choose to pay by Credit Card or PayPal. For Portuguese territory, NITACARE provides the following payment methods:

ATM

You can pay at an ATM terminal or at a Homebanking service. In this case, you have 3 days to make the payment of your order. On the fourth day, it will be cancelled. Just select the menu Payments for Services / Buy and enter the data provided by email for order confirmation: entity, reference and value.

Payment confirmation is received in real time, updating the order status. Keep the proof of payment.

MB Way

To pay by MB Way just have the MB WAY application and associate your bank card with the mobile number at the ATM. Learn more at www.mbway.pt.

When selecting the payment method, you must select the MB Way method and enter your mobile number.

You must validate the payment in the MB Way app notification area and confirm with your PIN or Touch ID.

In this case, you have 10 minutes to make the payment. After 10 minutes the order will be canceled.

Credit card

After clicking “Checkout”, you will be redirected to the MyPOS page where you will be asked for your card details such as your credit card number, expiration date and security code. Once paid, the amount will be debited from your credit card account.

Paypal

If you choose this payment method, you will be redirected to the PayPal page to complete the transaction.

Note: All payments made at www.nitacare.com will appear as “NC Pharma Unipessoal Lda” on your bank statement.

All payments will be debited in euros.

  • Order Delivery

After the order has been shipped, the User will receive a confirmation email with the assigned shipping number and a link so that they can track the order on the carrier’s website.

It is important that the address you specify for order delivery is correct and that the User is available to receive it. Entering an incorrect or incomplete address may result in the order being returned to NITACARE and may incur additional charges to you.

If you need to change the delivery address after you have placed an order, please contact our Customer Support, who will check if it is still possible to change your address.

For all orders, shipping costs are calculated automatically, depending on the value of the order, the weight of the products and the tariffs of the carriers.

Delivery time is always dependent on payment confirmation and the chosen means of transport. We offer a standard service taken by DPD or CTT and the standard delivery time is as follows:

  • Portugal (Mainland): 1 to 2 business days;
  • Madeira and Azores: up to 5 business days;
  • European Community countries: 2-7 business days;
  • Countries outside the European Community: 2-10 business days.

For international shipments, we also offer DHL as an express alternative, with the standard delivery period being 1 to 2 business days after dispatch.

These delivery times may be extended during peak periods such as holidays, Christmas or New Year. Customs inspection situations may also delay the delivery. Orders will be delivered Monday through Friday, excluding local or national holidays (except PO Boxes).

Note: For countries outside the European Community, orders may be subject to applicable customs duties. All payments of customs duties or any other type of tax are the sole responsibility of the User.

  • Returns and Right of Free Resumption of Contract

Right of Free Resumption of Contract

The User has a period of 14 days from the day the consumer or a third party appointed by the consumer acquires physical possession of the goods, or the day when he acquires physical possession of the last property, in the case of several ordered goods in a single order and delivered separately, to terminate the contract without giving any reason in accordance with the provisions of Article 10 (1) of DL 24/2014, of 14 February.

If the User so wishes, he/she may use his right of free termination of the Contract provided that the products are intact, sealed, complete and in the original packaging, which may not be damaged, altered or scratched. The User must ensure that the returned item (s) arrives at the facilities listed below within 14 days from the date on which he / she has notified us of his decision to terminate the contract. Otherwise it will not be accepted.

According to article 17 of Decree-Law no. 24/2014 of 14 February, sealed goods which cannot be returned due to health or hygiene protection when opened after delivery cannot be returned.

In order to make use of your right of free termination of the contract, simply contact our Customer Service, indicating the order number, description or reference of the product (s) you wish to return and how do you want to receive your refund.

The Customer Service will contact the User in a timely manner, acknowledging receipt of the intention to terminate the contract, to confirm the right to refund and provide any further clarification.

If the customer has purchased any product as part of a promotional campaign and has therefore benefited from an offer, the customer must return not only the paid product(s) but also the offer assigned. Returns of incomplete, damaged products without original packaging or signs of use will not be accepted. Returns will not be accepted for products with an explicit indication that the expiration date is approaching.

In the event of termination of the purchase agreement, payments made by User will be refunded, including initial shipping costs of the order, no later than 14 days from the date NITACARE is informed of the termination decision. NITACARE is not required to reimburse additional delivery costs when you expressly request a different and more costly delivery mode than the commonly accepted and less costly mode proposed by NITACARE. The refund will be made using the same payment method used in the initial transaction, unless expressly agreed otherwise by you. In any case, the customer does not incur any costs as a consequence of such refund. NITACARE reserves the right to withhold reimbursement as long as the goods are not received or until the consumer provides proof of return of the good, in accordance with Article 12 (4) of Decree-Law 24/2014. The costs of returning the order are borne by the User.

Returns and Exchanges

If for some reason you are not satisfied with your purchase, you may return it up to 14 consecutive days after the date of receipt of the order.

To return an order, please contact Customer Service, specifying the order details and whether to exchange or return the product (s).

If the customer has purchased any product as part of a promotional campaign and has therefore benefited from an offer, the customer must return not only the paid product(s) but also the offer assigned. After proceeding as directed by email for the return or exchange of product (s), you will receive a refund or a new product. In the event of a return, payments will be refunded to you no later than 14 days from the date we receipt the return at our facilities. . The refund will be made using the same payment method used in the initial transaction, unless expressly agreed otherwise by you.

Orders returned on charge will not be accepted.

In cases where it is found that the reason you want to return the order is because it is incorrect or the product is defective, NITACARE will refund the shipping amount for the return. In all other cases, the entire value of the item (s) is returned except the shipping value.

In the case of international shipments, where the intention of exchange or return was not originated by mistake of NITACARE, the shipping costs or any customs duties or other taxes that may be applied by the governmental authorities of the country will not be assumed as well as the cost of a new shipment.

In case the original payment was made by ATM, the customer will have to provide the bank details for refund to be made. In all other cases, where the original payment was made by PayPal or Credit Card, the refund will be made using the same payment method used in the initial transaction, unless expressly agreed otherwise by you.

Orders Not Delivered to User

In the event that an order is returned to NITACARE for reasons unenforceable to NITACARE or the carrier, the amount initial paid will be refunded, except shipping and return costs. 

5. Warranty

Products sold by NITACARE are covered by the legal regime for the sale of consumer goods contained in Decree-Law No. 67/2003 of 8 April, as amended by Decree-Law No. 84/2008 of 21 May.

All products are warranted by their respective brands which unless otherwise stated is 2 years.

6. Alternative Dispute Resolution

In the event of a dispute, the consumer may refer to the Alternative Consumer Dispute Resolution entities identified on the consumer portal, www.consumidor.pt., Or the Online Consumer Dispute Resolution entities identified on the portal.https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=PT

7. Data Privacy Policy

Registering as a User on the NITACARE website requires understanding and acceptance of this Privacy and Data Protection Policy.

NITACARE understands and respects the concern for the privacy of personal data provided by stating our commitment to transparency in a clear and unambiguous manner.

At any time, you may exercise your right of access, rectification, opposition and deletion in writing to Rua Conselheiro Veloso da Cruz, 621 4400-095 Vila Nova de Gaia or by email at help@nitacare.com.

  • Types of Personal Data Collected

The new General Data Protection Regulation (RGPD) defines that a personal data is any information capable of identifying a person, regardless of its nature and the medium on which it presents itself.

The required data collected by NITACARE is the name, email and address to process the purchase, open the customer form and be able to deliver the order. The tax identification number is optional.

Required fields on available forms are marked with an asterisk (*).

When you make a purchase, you will also be asked for payment details to ensure the highest possible efficiency and delivery time.

The data provided will be kept for the strictly necessary period, which normally corresponds to the period of existence of the customer account or, until it exercises its right of objection or right of deletion.

Your personal data will be processed by NITACARE for the purpose of customer management and, if accepted, for sending marketing communications. If you do not wish to be contacted for marketing purposes, you may unsubscribe from the newsletter at any time.

If the customer contacts NITACARE on their own initiative by telephone to inquire about the products, the purchase process, the status of an order or to report any situation related to the site, may be required to collect additional personal data for various purposes, such as to confirm the customer’s identity and reason for contact.

When processing a specific order, NITACARE may need to contact the customer in order to collect additional information about the order.

  • Data Sharing

Whenever strictly necessary, NITACARE may transmit your personal data to third parties, such as freight forwarding companies, solely for the purpose of performing a delivery service, to banking entities for the processing of payment for your orders or law enforcement, to State Entities such as the Tax Authority.

NITACARE does not under any circumstances share your personal data with other companies or brands for other business purposes.

  • Data Processing Security

NITACARE respects your concern for the privacy of your data. If you are a registered user on our site, with a customer account, your information is protected by a password of your choice. The User shall keep the customer account access data secure and shall not share it with anyone. It is recommended that you do not save your password in your browser, as someone else with access to your computer may access your personal information.

With regard to the personal data provided for customer management, NITACARE is responsible for protecting it through SSL security technology.

Notwithstanding all efforts made by NITACARE to protect your data, it is our duty to inform you in accordance with Article 10 (4) of Law 67/1998 that your personal data may circulate on the network without secure conditions, running the risk of being seen and used by unauthorized third parties.

Cookies enable us to improve the performance and browsing experience of our users on the site, such as avoiding the need to repeatedly enter the same information, to recognize your device and to direct your browsing to their interests and preferences. At no time do cookies collect personal information that enables us to identify you and only store generic information.

The Terms and Conditions of Use for www.nitacare.com and its subdomains are governed by the applicable laws of Portugal. The User agrees that any legal action arising or related to these Terms and Conditions of Use will be resolved towards the Portuguese courts.
